These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Topz Hyper Technologies Private Limited (“Topz Hyper”, “we”, “us”, or “our”), governing your access to and use of the Topz Hyper mobile application on iOS and Android, our website located at topzhyper.com, and associated software and services (collectively, the “Platform”).
By downloading, registering for, or using the Platform, you expressly represent that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately uninstall the application and refrain from accessing the Platform.
1. User Eligibility (Strict 18+ Rule)
Topz Hyper is designed exclusively for adult social discovery and community building. You must be at least eighteen (18) years of age to create an account or use any feature of the Platform.
- By creating an account, you affirm that you are at least 18 years old and legally competent to enter into this agreement.
- You represent that you have not been previously banned or suspended from the Platform for safety violations.
- You represent that you have not been convicted of any felony or offense involving sexual misconduct, violence, or harassment.
2. Account Registration, Security & Verification
To access circles and voice lounges, you must create a registered account using a valid mobile telephone number:
- You agree to provide accurate, current, and truthful registration information. Impersonation of any individual, celebrity, or brand is strictly forbidden.
- You are solely responsible for maintaining the confidentiality of your authentication credentials and mobile device security.
- To maintain community integrity, accounts are subjected to our Trust Shield™ 3D selfie liveness verification to confirm you are a living human. Circumventing verification using synthetic media, deepfakes, or photographs of third parties will result in an immediate permanent ban.
3. Community Code of Conduct & Zero-Tolerance Directives
Topz Hyper is built on authenticity, respect, and positive connection. We enforce a strict zero-tolerance policy for antisocial, unlawful, and predatory behavior:

4. Real-Time Audio Hangouts & Voice Room Etiquette
Audio lounges are shared community spaces. When participating in voice rooms:
- Users must respect room hosts, speakers, and community norms.
- Broadcasting ear-splitting noise, blaring music without permission, shouting slurs, or disrupting conversations is strictly prohibited.
- Room moderators and automated speech-safety monitors have the right to mute or remove disruptive participants immediately.
- Audio feeds are transmitted live via WebRTC and are not recorded on permanent storage. In the case of severe harassment complaints, a temporary 60-second rolling buffer may be evaluated by human safety specialists to resolve immediate threats.
5. User-Generated Content & Intellectual Property Rights
You retain all copyright and proprietary rights to the photos, bios, vibe tags, and original text you submit to Topz Hyper.
- License to Topz Hyper: By publishing content on the Platform, you grant Topz Hyper a worldwide, non-exclusive, royalty-free license to host, store, display, and reproduce your content solely to deliver platform functionality.
- Proprietary Rights: All Topz Hyper trademarks, logos, interface designs, graphics, audio branding, animations, and computer code are the exclusive intellectual property of Topz Hyper Technologies Private Limited. You may not copy, reverse engineer, decompile, or modify any portion of the software.
6. Account Termination & Self-Service Deletion
You have the unconditional right to terminate your account at any time:
- You can permanently delete your account directly inside the mobile app via Settings > Account & Security > Delete Account or through our web deletion portal at topzhyper.com/delete.
- Upon account deletion, your personal records, chat messages, and interest circles will be permanently expunged according to our Privacy Policy retention schedule.
- Topz Hyper reserves the right to suspend or terminate any account, with or without prior notice, if you breach these Terms or engage in conduct detrimental to the community.
7. Disclaimers of Warranties
The Topz Hyper Platform and all associated content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
We do not warrant that the Platform will be uninterrupted, error-free, completely secure, or free from malicious components. While we employ 3D selfie verification to eliminate fake profiles, Topz Hyper does not perform criminal background checks on all members. You are solely responsible for exercising caution and good judgment in all interactions with other users.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Topz Hyper Technologies Private Limited, its directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, emotional distress, or damage arising from your use of the Platform or interactions with other members.
9. Indemnification
You agree to defend, indemnify, and hold harmless Topz Hyper Technologies Private Limited, its officers, employees, and agents from any claims, liabilities, damages, losses, or legal costs arising out of your violation of these Terms, your user content, or your misuse of the Platform.
10. Dispute Resolution & Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of India, without regard to conflict of law principles. Any dispute, legal suit, or claim arising out of or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.
